Welcome to Properties around the Globe LLC (“the Company”). This Terms of Use Agreement (“Agreement”) sets forth the legally binding terms and conditions that govern your use of our website and services. By accessing or utilizing our website or any of the services provided by the Company, you, the user (“the Buyer”), hereby agree to abide by and be legally bound by this Agreement. It is imperative that you read this Agreement carefully. Should you not concur with any part of this Agreement, you are advised to refrain from using the Company’s website and its associated services.

Article 1: Scope of Services
Section 1.1: Consultation and Facilitation of Introductions to Property Developers

The Company will introduce the Buyer directly to property developers involved in off-plan projects across the globe.
Such introductions will be conducted remotely, utilizing various communication technologies. The Company will act as a liaison between the Buyer and the Developer to facilitate initial discussions and potential investment opportunities.

Section 1.2: Query Resolution and Customer Support
The Company pledges to provide exemplary customer service to address any questions, concerns, or queries the buyer may have. Support shall be available through email and telephone communications, which will be facilitated remotely.

Section 1.3: Continuous Developer Availability

The property Developer will remain accessible to the Buyer for the duration of the project. All interactions will take place remotely to conform to the off-plan nature of the project and to avoid necessitating any physical presence.

Article 2: Fees and Financial Obligations
Section 2.1: Detailed Overview of Service Fee Structure
The Buyer is required to pay a non-refundable, one-time service fee to the Company in connection with the acquisition of any off-plan project or property. The service fee is specifically designated for covering administrative, processing, and other costs incurred by the Company in facilitating the purchase.

Amount and Currency
The service fee is set at Five Hundred United States Dollars (USD 500). All payments should be made in U.S. currency.

Payment Terms
The service fee is due and payable upon the signing of the property or project acquisition agreement. Failure to remit the service fee as specified may result in the delay or cancellation of the transaction at the Company’s discretion.

Non-Refundable Nature
It is important to note that the service fee is non-refundable. Once paid, the fee will not be returned under any circumstances, including but not limited to, the withdrawal, cancellation, or termination of the property or project acquisition by the Buyer.

By remitting the service fee, the Buyer acknowledges and agrees to the terms outlined in this section.

Section 2.2: Commission Refunds
Upon successful purchase, the Company shall refund to the Buyer any standard commissions received from the developer. The modalities of this refund process will be detailed in the separate agreement executed between the buyer and the Company.

Section 2.3: Banking and Currency Conversion Fees
The Buyer shall bear any and all additional costs associated with the transfer of funds, including but not limited to wire transfer fees, currency conversion charges, and other bank-related fees. The rates applicable for currency conversion shall be the prevailing rates on the date of the transaction.

Article 3: Disclaimers and Limitation of Liability
The Company provides all services and information on an “as-is” and “as-available” basis. No warranties, either express or implied, are made concerning the accuracy, reliability, or completeness of any information provided. The company shall not be liable for any direct, indirect, incidental, special, or consequential damages that result from the use or inability to use the services.

Limitation of Liability for Developer Delays or Non-Completion
The Company shall not be held responsible or liable for any delays, non-performance, or non-completion of projects undertaken by Developers contracted through or affiliated with the company. The Buyer acknowledges that developers are independent contractors and not agents or employees of the Company. Therefore, the Company cannot guarantee the completion, timeline, or quality of any project undertaken by such Developers.
In the event of a delay, failure to perform, or non-completion of a project by a Developer, the Buyer’s sole and exclusive remedy shall be to seek recourse from the Developer directly. The Company shall have no obligation to provide a refund, compensation, or undertake any corrective action in relation to such delays, non-performance, or non-completion.
The Buyer hereby releases, indemnifies, and holds harmless the Company, its agents, employees, and affiliates from any and all claims, liabilities, damages, and/or costs arising from or related to the performance, non-performance, delay, or non-completion of projects by Developers.

Article 4: Amendments
The Company reserves the right, according to the laws in Delaware, to modify or replace this Agreement at any time.
Such amendments will become effective immediately upon posting on the website.

Article 5: Governing Law and Jurisdiction
This Agreement shall be governed by, and interpreted in accordance with, the laws of the State of Delaware, United States of America, without regard to its conflict of law provisions.

Effective Date
